5. Legal bases
Where Swiss data protection law applies, we process personal data in accordance with its statutory requirements, in particular the principles of lawfulness, proportionality, purpose limitation and data security. Where the GDPR applies, depending on the circumstances we rely on performance of a contract or pre-contractual measures, consent, legal obligations or legitimate interests. Legitimate interests may include communication, website security, customer support, improving our services and enforcing legal claims.
6. Website, cookies and similar technologies
When you visit our website, technical data necessary to establish the connection, display the website, ensure security and analyse errors is processed. Our website may use cookies and similar technologies. Cookies are small files that may be stored on your device. They may be necessary for operating the website or may be used for analytics, improvement and, where applicable, marketing.
You can configure your browser to block or delete cookies or to store them only after asking for your permission. Blocking cookies may limit certain website functions.
6.1 Google Tag Manager and Google services
Google Tag Manager is integrated into the website and is used to centrally manage website tags. It may itself transmit technical data such as the IP address to Google; additional Google or third-party analytics or marketing services may also be delivered through it, depending on the configuration. Google may process data in countries outside Switzerland and the European Economic Area, in particular in the United States.
Google Maps is embedded on the contact page to display our location. When the map is loaded, data such as your IP address, device information and usage data may be transmitted to Google. Google's privacy information additionally applies to processing by Google.
6.2 Webflow, forms and security services
Our website was created with Webflow and is provided via Webflow's technical infrastructure and service providers connected with Webflow. When you use the website and submit forms, technical data and form content may be processed through this infrastructure.
Cloudflare Turnstile may be used to protect forms against automated or abusive use. Cloudflare processes technical information about access, the device and interaction with the form in order to determine whether an entry was made by a human.
6.3 suissetec service calculator
A service tool from suissetec is integrated into the website. If you use the simple price calculators, the information you enter there and technical usage data are transmitted to and processed by suissetec. Depending on your entries, this may include information about the building, the current heating system, energy requirements, location or contact details and other information relevant to calculation and advice.
6.4 Other integrated services and content
External services and content delivery networks may be integrated for the presentation, functionality and animation of the website, including Webflow CDN, jsDelivr, Finsweet, GSAP, Refokus Tools and Slater. When such content is retrieved, technical data, in particular your IP address and browser information, may be transmitted to the respective providers.
7. Contact forms and communication
If you contact us via the contact form, by email, telephone or by other means, we process the information you provide in order to handle your enquiry and any follow-up questions. The contact form requests in particular your first and last name, email address, telephone number and message. Required fields are marked accordingly; without this information, we may be unable to process your enquiry.
8. Applications
If you apply to us via our website or by other means, we process your application data to assess your application, communicate with you and conduct the recruitment process. Online application forms may request, in particular, the position, first name, email address, telephone number, address and a message. If you send us additional documents or information, we also process these as part of the recruitment process.
Application data is made available only to persons who require it to process the application. If no employment relationship is established, we delete or anonymise application data after completion of the recruitment process unless consent has been given for longer retention or statutory requirements or legitimate interests justify longer retention.
9. Disclosure of personal data
We disclose personal data only where necessary for the purposes described above, where there is a legal obligation, where you have consented or where we have a legitimate interest in doing so. Recipients may include in particular:
- IT, hosting, web, form, security and support service providers;
- providers of embedded website services, e.g. Google, Webflow, Cloudflare and Eturnity;
- consultants, fiduciaries, insurers, banks, legal representatives and authorities;
- suppliers, partners, subcontractors or manufacturers where necessary for handling projects, service cases or customer enquiries;
- other recipients where necessary for contract performance, safeguarding our rights or complying with legal obligations.
We do not sell personal data.
10. Processing of data abroad
We generally process personal data in Switzerland and the European Economic Area. Through the use of international service providers, particularly in connection with website technologies, analytics, maps, security or platform services, personal data may also be transferred to other countries, including the United States.
If data is transferred to a country without an adequate level of data protection, we provide appropriate safeguards in accordance with applicable data protection law, in particular contractual safeguards, unless a statutory exception applies, for example your consent, performance of a contract or the assertion of legal claims.
11. Retention period
We retain personal data only for as long as necessary for the purposes for which it was collected, for as long as we have a legitimate interest in retaining it or for as long as statutory retention and documentation obligations apply. Business records may in particular be retained for several years due to commercial and tax law obligations. Technical log data is generally retained for shorter periods unless security or evidentiary purposes require longer retention.
12. Data security
We take appropriate technical and organisational security measures to protect personal data against unauthorised access, loss, misuse, alteration or disclosure. Depending on the circumstances, these measures include access restrictions, encryption, backups, organisational instructions and careful selection of service providers. Despite such measures, security risks can never be completely excluded.
13. Your rights
Subject to applicable data protection law, you have in particular the right to request information about the personal data we process, to have inaccurate data corrected, to request deletion of data, to restrict or object to processing, to withdraw consent previously given, and to receive or have certain data transferred in a commonly used electronic format.
These rights may be subject to statutory requirements, exceptions or restrictions, for example to protect trade secrets, third-party rights or to comply with legal obligations. You may also lodge a complaint with the competent data protection supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC).
14. External links
Our website may contain links to third-party websites. The respective operators are responsible for their content, security and data processing. Their privacy policies and terms of use apply when you access external websites.
15. Copyright and website content
Unless otherwise stated, copyright and all other rights to content, images, photographs, graphics, text, logos and other files on this website belong to Burkhardt Gebäudetechnik AG or the respective rights holders. 16. Changes to this Privacy Policy
We may amend this Privacy Policy at any time, in particular if we change our data processing activities or new legal requirements apply. The current version published on our website applies.
